Terms of service

The service

Dealiteful is a mobile app that notifies you about offers at nearby participating locations, lets you save them for later, and compares product prices between online sellers and shops around you. Installing or using the app means you accept these terms. If you do not accept them, do not use the app.

Eligibility and accounts

You must be at least 13 years old to use Dealiteful. Browsing and redeeming deals do not require an account. Where you do give us an email address — early access, support, a merchant registration — keep your details accurate and your access to yourself, and tell us if someone else gains control of it.

Deals belong to the merchant, not to us

Every offer is created, priced, limited and honoured by the merchant that published it. We display it; we do not sell it and we are not a party to your purchase. Availability, conditions, stock and expiry are the merchant's to set, and an offer can end or sell out before you arrive. If a merchant refuses a valid deal, tell us — we follow up and can remove a location from the network — but the transaction itself remains between you and them.

Compare prices are indicative

Comparison results come from Dealilah and the retailer and marketplace data it reads. Prices, availability and in-store stock can be delayed, incomplete or wrong, and can change between your search and the checkout. Treat results as a guide, not a quote or an offer, and check the final price with the seller. A "best buy" recommendation is an automated suggestion, not advice.

Permissions, battery and your device

Nearby deals need Bluetooth and the location permission your operating system requires for beacon scanning; notifications are optional. Background scanning uses some battery and mobile data. You are responsible for your own device settings, carrier costs, and for keeping the app updated. How we handle data is set out in the privacy policy.

Acceptable use

• Do not attempt to spoof, clone, jam or tamper with beacons, or impersonate a merchant or location.
• Do not scrape, resell or redistribute deal or price data from the app.
• Do not reverse engineer, decompile or interfere with the app or our services beyond what the law allows.
• Do not use the app to break the law, harass anyone, or defraud a merchant.

If you are a merchant

By publishing a deal you confirm you are entitled to offer it, that its terms are accurate and lawful, and that you will honour it for anyone who presents it while it is valid. You are responsible for your own pricing, tax, consumer-law and advertising obligations. Beacon hardware supplied or approved by us must be placed where it is safe and lawful to do so. We may remove a deal or a location that is misleading, unlawful, or repeatedly not honoured. Hardware and listing charges are set out in your merchant agreement or order confirmation.

Our content

The Dealiteful app, name, logo, interface and content are owned by Sensimity by The RO Brand or its licensors. You get a personal, revocable, non-transferable licence to use the app for its intended purpose. Merchant names, logos and offer text belong to the merchants.

Availability and changes

Dealiteful is pre-launch, and features may change, break or be withdrawn. We may update the app, these terms or the service itself; material changes to these terms will be announced in the app or by email before they take effect, and continuing to use the app after that means you accept them.

Disclaimers

The app is provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded by law. We do not warrant that deals will be available, that notifications will always arrive, that price data will be accurate, or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, for lost savings or profits, or for a merchant's acts or omissions. Where liability cannot be excluded, our total liability to you is limited to [USD 100 / the amount you paid us in the preceding twelve months, whichever is greater]. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Consumer rights you hold under mandatory local law are unaffected.

Ending the agreement

You can stop at any time by uninstalling the app; saved deals stored on your device go with it. We may suspend or end your access if you breach these terms or use the service in a way that harms merchants or other users. Sections that by their nature survive termination — intellectual property, disclaimers, liability, governing law — continue to apply.

Governing law and disputes

These terms are governed by the laws of [state, e.g. the State of Delaware], United States, without regard to conflict-of-laws rules, and disputes will be brought in the courts of [venue] — except where mandatory consumer-protection law in your country of residence gives you the right to bring a claim locally, which we do not seek to override. [If you want arbitration and a class-action waiver, they must be added here and reviewed by counsel.]
